Probate Court Jurisdiction

In Georgia, Probate Court has exclusive jurisdiction over:

  • Probate of wills
  • Administration of estates
  • Appointment and removal of executors and administrators
  • Appointment and removal of guardians and conservators of incapacitated adults
  • Sale and disposition of estate property
  • Audit of returns of executors, administrators and guardians
  • Temporary guardianship of minor children
  • Commitments to involuntary evaluation and treatment for people with mental, drug or alcohol issues.
  • Storage of wills of living persons for safekeeping.
  • Issuance of marriage licenses, Georgia Weapons Carry Licenses, certificates of residency and permits for fireworks displays
  • Administering oaths of office to elected officials
  • Presiding over habeas corpus or criminal preliminary hearing
